Important: These Terms apply to business customers only. If you are a consumer, you must not use the Services.
1. Introduction
The protection of privacy of those using our services is very important to WeAlert and we have implemented policies and procedures to ensure this protection.
This Privacy Policy explains what kinds of personal information we collect from you when you visit our website or use our services, how we use your personal information, who we might share information with (including when we might send your information overseas), and your rights in relation to the information we collect, including how you can find out about what personal information we hold about you and how you can complain about our use of your information.
2. Data We Collect
2.1 Data you give us (controller context)
Account & billing: name, business name, role, email, phone/WhatsApp, postal address, VAT details.
Communications: support requests, demo bookings, feedback.
Marketing preferences and consent records.
2.2 Data we process on your behalf (processor context)
End-customer contact data: names, phone numbers, email (if used), consent status, opt-in source (e.g., QR poster/table menu/receipt), unsubscribe status, message logs/metadata, review links and responses.
Optional: purchase value bands or tags, appointment times (if you import them), locations.
2.3 Automatically collected
Device, IP address, browser/OS, app usage events, referral URLs, cookies/SDK data, approximate location.
Log data for security, debugging, and fraud prevention.
3. Why We Use Data (purposes & legal bases)
As controller (our own users):
Provide and maintain the service, authenticate users, billing and collections (Contract).
Product analytics, feature improvement, fraud prevention (Legitimate interests).
Send service emails (password resets, notices) (Contract/Legitimate interests).
Send marketing with your consent; you can opt out anytime (Consent/Legitimate interests where permitted).
Comply with legal and tax obligations (Legal obligation).
As processor (on your behalf):
Store subscriber lists, send SMS/WhatsApp/email campaigns, manage opt-ins/opt-outs, generate review requests, measure campaign performance (Processor—per your instructions under the DPA).
4. SMS, WhatsApp, email & PECR/GDPR
For UK/EU audiences, you (the business customer) must obtain valid consent (or rely on a permitted soft-opt-in) and provide clear unsubscribe instructions.
Every SMS will automatically include your business name and opt-out (e.g., “Reply STOP to opt out” or click link to unsubscribe).
We record consent events (time, method, source such as QR code or form).
We will not use your subscriber lists for our own marketing.
5. Sharing & recipients
We use trusted service providers (sub-processors) for infrastructure and delivery, each bound by contracts and security obligations. Typical categories:
Infrastructure & hosting: cloud providers, databases, CDN.
Messaging providers: SMS/telecom gateways, email delivery.
Analytics & error monitoring: product analytics, crash reporting.
Payments: Stripe or equivalent.
Support & CRM: helpdesk, ticketing, CRM.
We’ll maintain a current sub-processor list at: [wealert.co.uk/legal/subprocessors] and will notify customers before material changes where required.
We may disclose information if required by law, to enforce our terms, or to protect rights, safety, and security.
6. International transfers
If data is transferred outside the UK/EEA, we use approved safeguards (e.g., UK IDT/EEA SCCs) and assess partner protections. Details are available on request.
7. Data retention
Customer (controller) data we control: keep for the duration of the contract plus up to 6 years for tax/accounting or dispute purposes, unless a shorter/longer period is required by law.
End-customer data we process for you: retained only as long as your account stores it; deleted or returned at contract end per our DPA, subject to lawful backups.
Marketing leads: retained until you opt out or after a reasonable inactivity period.
8. Your rights (UK/EU)
Depending on your location, you may have rights to access, rectify, erase, restrict, object, portability, and to withdraw consent.
If your data is processed by us as processor (e.g., you are a subscriber to one of our customers), please contact that business directly; we will assist them in fulfilling your request.

You can also lodge a complaint with the UK Information Commissioner’s Office (ICO): ico.org.uk. If you’re in the EEA, you may contact your local data protection authority.
9. Security
We implement administrative, technical, and physical controls appropriate to the risk, including encryption in transit, access controls, least-privilege principles, and regular monitoring. No system is 100% secure; we assess incidents and notify when legally required.
10. Cookies
We use cookies/SDKs for:
Essential: authentication, fraud prevention, core features.
Analytics: usage patterns to improve the product.
Marketing: measuring campaign performance and retargeting (where permitted).
You can manage preferences via our Cookie Banner/Settings and your browser settings.
11. Children
Our site and services are not intended for or directed to children (under the age of 13 in the United States or under the age of 16 in the EEA). We do not knowingly collect any personal information directly from children. If we discover we have received any personal information from a child under the age of 13 in violation of this Policy, we will take reasonable steps to delete that information as quickly as possible.

12. Access to and Correction of Your Personal Information
You have the right to access the Personal Information that we hold about you and to ask us to confirm what processing we carry out in relation to your Personal Information. If this information is not accurate, complete, or up to date, you may request that we correct it.
To make a request, please contact WeAlert’s Data Protection Lead at privacy@wealert.co.uk. Generally, WeAlert will not charge a fee for providing access; however, we reserve the right to charge a reasonable fee if your request is manifestly unfounded, excessive, or repetitive, or if you request further copies of the same information.
For residents of the United States, WeAlert complies with applicable Data Protection Legislation where relevant, which may include state privacy laws such as the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) and/or the Colorado Privacy Act (CPA).
To access or change your information online, you must log in using the unique username and password created when establishing your WeAlert account. To access Personal Information via WeAlert Support over the telephone, you may be required to verify your identity by confirming existing account details held by WeAlert.
13. Changes to our Privacy Policy
By providing WeAlert with your Personal Information and using the services provided, you consent to the collection, use and sharing of your Personal Information in the manner described in this Privacy Policy. We may amend this Privacy Policy from time to time. We encourage you to check our Privacy Policy regularly as any changes will take effect when they are made or published on our website, as by continuing to use our services, you will be agreeing to the changes we have made to our Privacy Policy.
